Playmaker Terms of Service and Privacy policy

Welcome to Playmaker Studios ("we," "our," or "us"). By accessing or using our services, you agree to the following Terms of Service. These terms govern the production and delivery of customised sporting player card packages ("Products").

1. Process

1.1. Customers must provide all necessary information, including names, images, and other required details, through our secure online process. The information provided must be accurate and complete.

1.2. All orders are subject to review and approval. We reserve the right to reject any order that violates our content guidelines or legal obligations under the Privacy Act 1988 (Cth) or the Copyright Act 1968 (Cth).

1.3. Customers are responsible for ensuring they have the legal right to use any images or details submitted for the creation of customised cards. For minors, appropriate parental or guardian consent must be obtained before submitting their information, as required by the Privacy and Data Protection Act 2014 (Vic).

2. Responsibility for Quality

2.1. We strive to produce high-quality Products. Customers are encouraged to review and test image quality before they are uploaded for production purposes.

2.2 We will conduct a review of image quality and player profile accuracy 2 weeks from the intended distribution date as nominated by the Customer on the Package Detail Form. If images or player profiles require clarification or updating, we will contact the Customer to remedy.

2.3 Variations in colour, material, or design may occur due to printing processes or materials used. Such variations are not considered defects.

2.4 We are not responsible for errors in the final Product that result from inaccuracies or omissions in the information submitted by the customer.

2.5. Our obligations under this clause comply with the guarantees provided by the Australian Consumer Law, as contained in the Competition and Consumer Act 2010 (Cth).

3. Payment

3.1. Payment must be made in full at the time of order placement. We accept payments via major Credit/Debit cards or via PayPal.

3.2. Prices are quoted in Australian Dollars (AUD) and include Goods and Services Tax (GST) unless otherwise stated.

3.3. If a payment fails or is disputed, we reserve the right to suspend or cancel the order.

3.4. Electronic transactions are governed by the Electronic Transactions Act 1999 (Cth) and the Electronic Transactions (Victoria) Act 2000 (Vic).

4. Delivery Timeframes

4.1. We will endeavour to make sure packages arrive at delivery addresses in time for the nominated distribution date advised by the Customer on the Package Detail Form. 

4.2 We require a minimum of 2 weeks production and delivery time from the time of final image upload and player profiles by the Customer. Final image upload time is considered after a quality and accuracy review is completed us and any defects/updates are remedied by the Customer.

4.3 Estimated delivery times will be provided at dispatch. These estimates are subject to change due to factors beyond our control, such as delays in production or shipping.

4.4. Customers are responsible for providing accurate delivery addresses. We are not liable for delays or non-delivery resulting from incorrect address details.

4.5. If a delay is anticipated, we will notify the customer as soon as possible and provide an updated delivery timeframe.

5. Refunds and Cancellations

5.1. Refunds will only be issued in cases where the Product is defective (including mismatch of player images/details) or damaged upon arrival.

5.2. We are not responsible for damages or issues caused during transit. Customers are encouraged to contact the delivery carrier directly for such claims.

5.3 Order cancellation requests must be made before 14 days of nominated distribution date advised by the Customer on the Package Detail Form. 

5.4. Order cancellation requests can be submitted via email to admin@playmakerstudios.com.au, with the subject ‘Cancel Order Number ##’, with the order number included by the Customer.

5.5. If a cancellation is approved, we will process a refund of the full amount less a $20 administration fee within 14 days of approving the cancellation.

5.6. All refund and return policies comply with the Australian Consumer Law, as contained in the Competition and Consumer Act 2010 (Cth).

6. Limitation of Liability

6.1. To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from the use of our services or Products.

6.2. Our total liability for any claim related to the Products shall not exceed the amount paid for the specific order in question.

6.3. This clause is subject to the rights and remedies provided under the Australian Consumer Law.

7. Privacy and Data Protection

7.1. All personal information provided by customers is handled in accordance with our Privacy Policy and the Privacy Act 1988 (Cth). By submitting information, you consent to its use for the purpose of creating and delivering the Products.

7.2. For information relating to minors, we adhere to the Privacy and Data Protection Act 2014 (Vic), requiring appropriate parental or guardian consent before collection or use.

7.3. We take reasonable measures to secure customer data but cannot guarantee complete security against unauthorized access or breaches.

7.4. By submitting any image that includes a minor (any individual under the age of 18), you affirm that you are the parent or legal guardian of the minor depicted, or that you have obtained express, verifiable permission from the parent or legal guardian to use and submit the image.

Do not upload any images of minors without the appropriate legal consent. Unauthorized use of images involving minors may result in removal of the content, suspension of your account, and potential legal action.

We take the privacy and safety of minors seriously. Submissions that violate this policy will be handled in accordance with our terms of service and applicable laws.

8. Governing Law

8.1. These Terms of Service are governed by the laws of Victoria, Australia, including the Fair Trading Act 1999 (Vic) and the Australian Consumer Law.

8.2. Any disputes arising under these terms shall be resolved in the courts of Victoria.
